Debt letters

I only moved into this place a couple of months ago. Yesterday I got a letter in the post from a debt recovery agency over an unpaid gas bill from 6 months ago. It was addressed to 'The Occupier' how cheeky is that? :mad:

to be fair, maybe the letter has time travelling prescience, is able to judge that you may be in debt one day, so its just warning you.

From experience: check if the previous occupant removed his address from your place, and if not, make sure it is removed A.S.A.P. (there should be an administrative procedure for doing so). If not, your stuff can and will be seized to repay the previous person's debts, and good luck on getting anything at all back.

I'm still getting debt letters addressed to 'The occupier.' Apparently they'll issue court proceedings if I don't pay this debt (which isn't mine!) I'm not sure you can take 'an occupier' to court, I think you need a name. Anyway I have documentary evidence that I didn't live at this address when the debt was incurred. I just think it's a bloody cheek that I have to deal with someone else's debt! :mad:

They can't take anything. They don't even have a name. They can only force someone to pay someone elses debt if they co-signed a loan, or acted as a guarantor for a loan.

If you're living where the person with debts has his legal address, they will take your stuff, and unless you kept receipts (no one does that) of everything, good luck getting it back.

Since in this case they seem to not have a name, it's likely a scam though.

Debt is owed by a named individual, not an address. Bailiffs can visit so just show ID, tenancy agreement, when you moved in, electoral roll etc proving you are not the debtor.

It isn't really anything to worry about.

Never invite a bailiff into your house under any circumstances unless they have a warrant for YOUR debt, and obviously as you are not the named debtor they won't have a valid warrant anyway.

Surely its up the people to prove she owes the debt not other way around as there is no name

Here's what I would do.

Have a laugh and play them at their own game.

It will cost you a stamp. But could prove valuable if you play your cards right..;)


Write to them and give them your full name and say this....

"I do not wish to receive any more letters from you and any further letters from you will incur a fee of £500."

This is all you need to do...Leave it at that.

All goes to plan...You won't ever hear from them again....Or watch the money rolling in if they bite. ;)

Can’t pay or won’t pay I incurred debt’s and fines I ran for a bit and they found me so I paid up I’m debt and fine free now !
